我們先來看看這一年多來，發生在台灣社會不太起眼的幾個社會事件。

公車上的跌倒姊

去年有個公車「跌倒姊」，不知為何在公車上跌倒的機率頗高，報載2年就摔倒4次，並向司機求償最高有100萬元之譜，根據報載，雖然多以幾萬元和解收場，但「跌倒姊」甚至有一天就曾提出兩件告訴的情形發生。

助跑姊與跳跳哥

最近行車記錄器錄下的「助跑姊」與「跳跳哥」，他們等在路邊伺機等待路過車輛，之後（助跑）往車輛衝假裝被撞，再向路過的車主要求賠償。

這樣的案件，在以往只會被認為是單純的交通事故，後來發現其中「案情並不單純」，「助跑姐」與「跳跳哥」經常是想要「製造」駕駛人的過失，受到被撞的損害，然後要駕駛人提出一筆金錢和解，以求賠償。

網路訟棍族

聊天室、PTT，「網路訟棍族」的存在早已是司空見慣的事。他們在話題當中，特別挑釁、激怒他人，讓人們一時情緒性未經思考、即口出惡言，然後以對方涉嫌「公然侮辱」提告為要脅，使人拿出一筆筆的和解金，以避免到法院涉訟。

威脅要告，是一門好生意？

魯道夫．馮．耶林（Rudolf von Jhering），這位19世紀著名的德國法學家，他著稱於世、流傳百年的一篇演講《為權利而鬥爭》（Der Kampf um’s Recht）(註)，是所有念法律系一年級的學生都知道的文章。

當中提到的「勿為不法，勿寬容不法」，鼓勵權利受到侵害的人不該忍受，應該挺身而出對抗不法，也是所有法律人所琅琅上口的名句。

或許是確實是受到歐美「為權利而奮鬥」此等觀念的影響，或許是因為《易經》當中「訟，終兇」的觀念早已褪流行，或是因為民智已開、民眾越來越懂得保護自己的權利，或是看到美國民眾動輒以小小的「受害」、獲得大大的賠償，這樣的彌補機制，最近被發揮得淋漓盡致，早已超越了填補損害的目的，而訴訟似乎已經變成了一種賺錢工具了。

金管會今天表示，明年3月起有酒駕紀錄車主，強制汽車責任險擬要加費新台幣2100元；如果把車借人，因他人酒駕，車主仍然可能被加費。

金管會預估若加費，強制車險保費收入每年可增8500萬元。

金融監督管理委員會今天預告強制汽車責任保險費率草案，金管會表示，今年仍然不調整汽車責任險的保費。

不過，為了杜絕駕駛人酒駕肇事，金管會強制汽車責任保險研議明年3月1日起，如果車主本身或者車子借他人酒駕遭到取締，酒駕紀錄將會被記入加費的因子，加費方式是以前一年的酒駕紀錄次數乘上固定金額2100元，並且沒有設定上限。

金管會解釋，前一年如果有一次酒駕紀錄，續保時要加費2100元；有2次酒駕紀錄，就會被加費4200元；3次就是6300元，依此類推。

車主應該注意，可能會被加費的情況，除了車主自己有酒駕紀錄，該車會被加費，車主擁有的其他車子，也會被加費；所以車主有2部車的話，就會被加費4200元。

金管會說，如果要把車借給他人駕駛，也應該要小心。金管會指出，車主如果把車子借給他人，他人酒駕而遭到取締，車主續保會被加費。

金管會表示，每年平均有酒駕事件約4萬多件，若依據要加費2100元計算，預估可以增加的保費收入最高可達8500萬元。

金管會指出，有關強制車險酒駕加費草案預告完畢後，會提交強制車險費率審議委員會審議，才正式發布，並在明年3月1日起正式實施。

2013年球季拿下太平洋聯盟打點王的淺村榮斗，是埼玉西武獅隊陣中的主力打者，高校就讀名門大阪桐蔭高校，2008年曾率領球隊進軍夏季甲子園，並在冠軍賽中擊敗常葉菊川高校拿下優勝，同時也在冠軍賽的最後一打席揮出全壘打，替自己的高中生涯劃下完美句點。該年選秀會議中，淺村以第三指名順位加入西武，背號承接偶像松井稼頭央在西武新人時期的背號──32號。

由於淺村是游擊手背景出身，加上機動力不差，因此常會支援其它守備位置，除了投捕手之外，幾乎所有守備位置都站過。此外淺村一直有不錯的長打能力，為了降低他的負擔，因此後期多以一壘手為主。2011年10月以4成60打率拿下生涯首座月MVP。

2013年西武招牌明星中島裕之挑戰美國職棒，原本規劃回到游擊的淺村，由於陣中幾名新人在游擊的表現不差，因此依舊以一壘為主，5月29日起一肩扛下西武第四棒的任務。10月4日面對樂天於滿壘時擊出清壘二壘打，幫助球隊下季後賽門票，8號再從羅德王牌投手成瀨善久擊出陽春全壘打，讓球隊確定在季後挑戰賽首輪擁有主場優勢，季末西武以八連勝完美收尾，身為陣中四棒的淺村功不可沒。

首度入選日本武士隊的淺村，和陣中另一名主力打者中田翔，是大阪桐蔭畢業的學長學弟。在這次的經典棒球對抗賽中，絕對是中華隊需要嚴加看管的重砲之一。
