爭產打爆頭　兄殺弟未遂判8年定讞

【劉昌松／台北報導】台南1對陳姓兄弟為了遺產爭得水火不容，哥哥前年竟持鐵鎚拔釘器猛敲弟弟的頭部10多下，弟弟頭破血流不止，被旁人送醫才撿回一命，最高法院依殺人未遂判哥哥徒刑8年定讞。

哥哥辯稱弟弟曾為了母親留下的土地，出言恐嚇要讓他的家人死，2人在前年8月27日在1處工地理論時發生衝突，是弟弟自己跌倒撞傷頭部才流血。

但法官根據證人證詞，認定哥哥在工地隨手拿起1邊為鐵鎚、1邊為拔釘器的板模工具，躲到水泥預拌車駕駛座後方，等弟弟洩完水泥上車時，哥哥猛然跨過椅子，將弟弟壓制住並猛打頭部10多下後離開，留下頭骨破裂的弟弟被其他工人發現，送醫急救。
