旺宏訴請美專利局裁定Spansion專利無效

旺宏電子(2337)今 表示，日前已向美國專利商標局(U.S. Patent and Trademark Office, USPTO)舉發Spansion控訴其侵權的專利無效。依據旺宏提供美國專利商標局的證據顯示，Spansion指控侵權的六項專利，均是他人早先的發明、已公開之技術或在該產業領域內顯而易見者，但Spansion當初申請專利時並未據實提供相關資料，致美國專利商標局未能審酌而准予專利。

就此，旺宏已提供詳盡的資料及範例證明Spansion該六項專利，皆是在Spansion提出美國專利申請前，即有先前技術(Prior Art)或已公開。依法，該等專利應予無效。旺宏因此依法訴請美國專利商標局裁定該等專利無效。
