標題[問題] 汽車理賠疑問

如標題~ 小弟一個月前在國道一號被後方的車子推撞 (第三臺撞到第二臺後撞到我) 因為撞擊力道很大 所以車子的後方受損很嚴重 最近車禍的肇責出來 是第三臺車要附完全的責任 小弟請修車廠估價修理費用需要47000左右(包含零件跟工資烤漆約各佔一半) 可是小弟的車是福特 Liyata車齡已經超過15年 所以對方的保險公司說只願意賠汽車的殘值17000 不然就報廢價格算給我 可是小弟在網路上爬文看到理賠金的計算方式在工資(烤漆也算在裡面) 部分是沒有折舊的問題 我所理解的理賠金額計算方式是 零件*折舊率+工錢 在小弟的例子裡(小弟把車子的折舊以10%計算) 這樣算出來的價錢是高於保險公司願意理賠的金額 請問這樣我可以主張以上面的算法要求理賠金嗎?? 還請板上的大大們提供意見>"※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 60.249.21.188
