【李銘宏／台北報導】一名男子半年來，在台北市承德路人行天橋欲跳橋三次，轄區警方將他勸下後，仍不斷勸說及鼓勵他，甚至還出資送他回鄉辦理證件。

今天凌晨3時許，戶籍在台南市40歲吳姓男子，到承德路的人行天橋上要跳橋，這已經是半年來的第三次，警方將他勸下後帶回派出所了解狀況，吳男的說法與半年前一樣，仍是證件遭竊無法找工作失志與沒錢回鄉辦證件，警方除不斷鼓勵他之外，甚至還問出他已經兩天未進食，因此送上麵包豆漿讓他裹腹。

警方表示，吳男有意願回台南市辦理身分證件，他們將全力協助，警方還怕吳男在途中受餓，自掏腰包到便利商店購買食物讓吳男在車上食用。

民國45年制定實施的軍事審判法，曾被宣告違憲並歷經多次修正，立法院明天修法，規劃把承平時現役軍人犯罪全由一般司法機關追訴、審理，軍審法面臨最大變革。

現行軍事審判法民國45年制定實施，歷經多次修正，民國86年10月3日大法官會議解釋，以行政權介入審判權，未充分保障人權等為由，要求必須在解釋後2年內完成修法。

民國88年10月，立法院三讀修正通過軍事審判法及軍事審判法施行法，軍法機關不再隸屬部隊，改設三級軍事法院，獨立於軍令體系外，取消軍事長官參審權，落實司法獨立精神，軍中原有的書面審查覆判制度也取消，改為上訴，以保障人權。

當時修法並刪除「國防部為最高軍事審判機關」規定，軍事審判機關改採地區制，設地方、高級、最高三級軍事法院；取消軍事長官核判權、覆議權及法庭組成核定權，不再讓行政權介入審判，以確保審判獨立；改採審檢分立，改進以往審檢職權不明的缺失。

民國92年6月又修正，賦予軍事檢察官上訴第三審權利，當事人如不服最高軍事法院宣告有期徒刑以上，或高等軍事法院宣告死刑、無期徒刑之上訴判決者，得以判決違背法令為理由，向最高法院提起上訴。同時當事人不服高等軍事法院宣告有期徒刑之上訴判決者，亦得以判決違背法令為由，向高等法院提起上訴。

陸軍下士洪仲丘今年(102年)7月在禁閉（悔過）期間，疑遭虐死案，引發社會對軍方以及軍事偵審的不信任，朝野達成共識，6日可望透過軍審法等修法，改革軍事審判制度，將承平時現役軍人犯罪全由一般司法機關追訴、審理，修法後洪仲丘案適用。

中國國民黨籍立法委員李貴敏晚間受訪表示，朝野都有共識承平時期全面回歸一般司法，但條文細節待討論。待軍事審判法修正後，洪仲丘案及類洪仲丘案件都可立刻移出軍審，以解決社會對軍審及軍中人權疑慮，其他非關軍中人權犯罪則6個月內移出。

根據渣打銀行調查顯示，中國大陸對亞洲地區的影響力超越美國，尤其以東北亞地區最顯著。

渣打銀行針對過去10年美國及中國大陸的經濟數據，以迴歸分析（Regression Analysis）對香港、台灣、印度、印尼、馬來西亞、菲律賓、新加坡、韓國、泰國及澳洲等亞洲10個國家及地區的經濟影響力。

結果發現，大陸對亞洲地區的影響力超越美國，尤其以東北亞最為明顯。香港是受大陸影響最多的經濟體，緊隨其後分別為新加坡、台灣、韓國、澳洲及馬來西亞。

渣打銀行亞洲區研究主管馬德威（David Mann）指出，總體經濟方面，2003年至2013年第 1季的10年間，美國經濟成長率每增減1個百分點，台灣的經濟成長約改變35%；大陸經濟每增減1個百分點，台灣的經濟增長約改變20%。

另外，再分析2008年至2013年第1季數據，美國經濟每增減1個百分點，對台灣的經濟成長改變幅度擴大至近50%，而大陸經濟每增減1個百分點，對台灣經濟成長改變幅度增加約80%。

分析發現，新加坡、香港、台灣及韓國近 2年與大陸經濟增長的關聯愈來愈高，而印度、菲律賓、印尼及泰國則較受美國影響。

調查指出，台灣對美國及大陸的出口，在2005年占總出口的比重分別約15%及22%；2012年對美國的出口比重已降至12%左右，但對大陸出口卻增至約27%。

再分析2012年10個亞洲國家及地區，有 8個國家或地區對大陸的貿易額超過美國，其中東北亞及澳洲對大陸的貿易額遠超過美國，只有菲律賓和印度出口至美國的數字較大陸高。

【陳偉周／基隆報導】基隆市53歲張姓女子涉嫌毆拳虐死72歲婆婆朱姓女子遭起訴，今年4月24日張女因負擔不起安養中心費用，將朱女接回家照顧，不料張女卻對朱女拳腳相向，導致10日後朱女臉部多處瘀青送醫不治，張女則謊稱，是朱女自己摔到才導致死亡。

但是醫院驗傷報告指出，朱女外傷是人為所致，張女才坦承，照顧朱女生活起居時，認為她故意刁難不配合，再加上過去與朱女相處不愉快，才會連續2天猛毆朱女頭部。本月2日，檢方依傷害致死罪起訴張女。

　　印尼軍方人員涉嫌謀殺、綁架等犯罪時有所聞，但軍事法庭往往輕判，凸顯軍隊管理問題，人權組織呼籲，將罪刑嚴重的官士兵交一般司法系統審理。

　　今年3月底，11名蒙面的軍方特種部隊官兵持AK-47步槍闖入日惹斯勒曼(Sleman)的西邦崗監獄，以近乎處決的方式槍殺4名囚犯。

　　經調查，犯案官兵坦承替被殺的同袍報仇，願接受司法制裁。檢方起訴3名帶頭者12年有期徒刑，其他共犯則求處8至10年不等的有期徒刑。

　　這起案件凸顯印尼軍隊改革成效不彰，人權組織呼籲修改法律，使犯重罪的軍人移送一般司法系統審理。

　　印尼「失蹤人員及暴力受害者委員會」成員哈里斯(Haris Azhar)向「紐約時報」(The New York Times)表示，軍事法庭是一間暗室，公眾和受害者無法進入，民眾不能依賴軍事法庭，因為它不能依法處理人權案例。

　　澳州國立大學學者米次納(Marcus Mietzner)說，這起監獄襲擊事件凸顯印尼軍方長期存在免罪文化，因為軍事法庭對軍隊士兵幾乎沒有威懾力。

　　事實上，印尼前國防部長蘇達索諾(Juwono Sudarsono)2009年曾和國會協商，允許軍警聯合調查軍方涉及重大犯罪的官士兵，並使一般司法和軍法系統結合。因印尼警方反對，此案無疾而終。

　　布魯塞爾研究機構國際危機組織(International Crisis Group)顧問瓊斯(Sidney Jones)指出，檢視迄今軍人涉及謀殺的案件中，實際上很少判刑超過4年刑期以上的案例。

　　特種部隊成員闖監行凶的案件再度喚起印尼社會要求改革軍法系統的聲浪，只是對於向來倚重軍方維持政局穩定的印尼政府而言，這一步可能還要等上一段時間。
