總統頒洪仲丘旌忠狀

針對國防部指頒給洪仲丘「旌忠狀」是由陸軍司令部向後備指揮部提出申請，並經後備指揮部審認後核發，無須經過國防部長、行政院長及總統核定一事，民進黨立委薛凌清查國防法規資料庫在今年5月9日修正的「國軍作戰或因公亡故官兵安葬紀念表揚實施辦法」第25條規定：「亡故官兵，由國防部陳報行政院呈請總統頒給旌忠狀，以資表揚」。
又每一紙「旌忠狀」全部都有「總統及行政院長職銜簽名章」，旌忠狀上的核發字號「旌字第xxxxx號」並非國防部後備指揮部權責核發之字號，薛凌要求國防部應該對於根據那一條條文規定：「旌忠狀是各軍司令部向國防部後備指揮部審認後核發，無須經過國防部長、行政院長及總統核定」。
薛凌質疑，若所有旌忠狀既然無須經過國防部長、行政院長及總統核定，那請問「旌忠狀」上之「總統及行政院長職銜簽名章」是從何而來？國防部也必須解釋「旌忠狀」上之「旌字第xxxxx號」確屬國防部後備指揮部之字號無誤！
薛凌要求，國防部應立即說明清楚，並說明今年5月9日修正的「國軍作戰或因公亡故官兵安葬紀念表揚實施辦法」第25條規定：「亡故官兵，由國防部陳報行政院呈請總統頒給旌忠狀，以資表揚」之條文是否不存在，否則，旌忠狀為何是國防部新聞稿所寫的「無須經過國防部長、行政院長及總統核定」，對於此一條文認知出現落差，請國防部立即解釋。
