「停止下班下課」修圖恐侵權

「什麼？明天不能下班！」昨日晚間網路上開始流傳一張TVBS新聞台「北北基明天停止下班下課」的新聞截圖，讓不少民眾以為電視新聞又出包了，連五月天主唱阿信都轉貼，吸引2000多位粉絲按讚。事後證實圖片是網友透過手機App製作，TVBS發表聲明表示，將保留法律追訴權。律師葉奇鑫指出，網友恐面臨著作權法中的重製權、改作權法律責任，而分享、散布網友則要看是否知道該圖為後製加工。

包括阿信在內的網友轉貼會不會有法律責任？葉奇鑫說，若在知情的情況下轉貼，也是侵害名譽與重製權，「比起修圖者，只少了改作權。」不過，若是誤以為電視台出包而轉貼，由於時事報導並沒有著作權，不會衍生相關法律責任。葉奇鑫指出，網友知情與否，則要以轉貼時標註的文字評論、轉貼出處是否註明為修圖來舉證。
