投保以多報少 員工受害雇主判賠

新竹市員姓女子在一家知名川菜館擔任外場員工，去年上班途中發生車禍，導致右手臂神經叢受損，向勞保局申請職業傷病及失能給付時，發現雇主投保金額不實，她薪資3萬2000元，卻投保2萬1000元。員女今年1月生產，申請生育給付也因此短少，她主張，雇主應賠償她少拿到的職業傷病、失能及生育給付等，法院判員工勝訴，雇主要賠償短少的30萬餘元。

員姓女子說，她前年12月開始到這家川菜館上班，負責外場工作，去年2月某日上班途中發生車禍，造成右手臂神經叢受損，她向勞保局申請職業傷病給付，發現她薪資是3萬2000元，雇主卻投保2萬1000元，投保薪資金額以多報少，造成她權益受損。

法院通知業者到庭表達意見，業者未現身，也沒有提出書狀做聲明或陳述。

法院認為，業者是投保單位，以多報少違反勞工保險條例規定，投保薪資影響給付金額，造成員工職業傷害補助費損失1萬7507元、職業傷害失能補助費損失27萬600元、生育補助費損失1萬2300元，共30萬407元，判業者應賠償員工損失。
