黑心廠商訂懲罰性賠償金 法務部反對

立法院司法法制委員會今天上午討論民法修正草案，焦點鎖定國民黨立委陳根德、蔣乃辛等人所提增訂「懲罰性賠償」制度，。主管機關法務部持保留態度。

法務部指出，懲罰性賠償金只適合在個別法規定，例如現行消保法、公平交易法、專利法、健康食品管理法等特別法，若對於無交易關係存在的一般行為，也設懲罰性賠償制度，實所非宜。

所謂懲罰性賠償制度是指，在民法增訂第195條之1，規定「如為故意不法侵害他人之行為者，法院得因被害人之請求，依侵害之情節，酌定五倍以下之懲罰性賠償金」，加重加害人的賠償責任。

法務部說，懲罰性賠償金制度，是英美法特有的制度，與我國民法損害賠償的制度不同，也不宜以懲罰性賠償金制度，作為制裁及預防犯罪的工具。
