罵夫女同事是小三　妻有合理懷疑獲不起訴

【黃哲民／新北報導】新北市已婚黃姓男子與銀行單身女同事互動密切，黃妻發現丈夫手機裡有丈夫與對方僅穿睡袍的親暱合照，憤而3度登門找對方理論，臭罵對方「搶人家老公」、「小三」等語，被控涉犯公然侮辱與誹謗罪嫌。新北地檢署指黃妻反應是人之常情，且有合理懷疑，將黃妻不起訴。

黃男原本也告妻子偷看手機與散布照片指摘外遇，涉犯妨害電腦使用與誹謗罪嫌，但主動撤告，他辯稱合照場合是公司團體出遊非獨處。

不過黃男也承認，站在妻子立場，看到這些照片確實會合理懷疑女同事是小三。

黃妻今年2月趁丈夫酒醉偷看丈夫手機，發現多張丈夫與女同事在飯店穿睡袍摟肩的親密照，氣得存到自己手機拿給親友看，除找對方理論，並告丈夫與對方涉嫌通姦，今年9月因證據不足被不起訴。
